Relating to students; to allow students in public and nonpublic schools the option to possess and use Federal Food and Drug Administration regulated over-the-counter sunscreen at school and at school-based events.
BE IT ENACTED BY THE LEGISLATURE OF ALABAMA:
Section 1:

Any student in a public school under the jurisdiction of a local board of education or in a nonpublic school may possess and apply Federal Food and Drug Administration regulated over-the-counter sunscreen at school and at school-based events notwithstanding any other provision of law, including any rule of the State Board of Education or the State Board of Nursing.

No rule of the State Board of Education or the State Board of Nursing shall apply to the possession or use of Federal Food and Drug Administration regulated over-the-counter sunscreen by students at a public or nonpublic school.

Any student, parent, or guardian requesting a school board employee to apply sunscreen to a student shall present to the nurse a Parent Prescriber Authorization Form (PPA) containing a parent or guardian signature. A physician's signature or physician order shall not be required.
Section 2:
This act shall become effective immediately following its passage and approval by the Governor or its otherwise becoming law.
